Marc Baetens-Spetschinsky’s practice focuses on consultation and dispute resolution in the areas of judicial law, including asset recovery (seizures and enforcement), and transport law (in particular aviation law). He is also active in cases before the Cour de cassation (Belgian Supreme Court).

Marc's fields of specialization

He advises and intervenes in the following areas:

national judicial law (in particular penalties and seizures) as well as European or international judicial law

air transportation law

Among other things, he has acquired significant expertise in matters relating to the Justice and Air Transport sectors.

Marc is therefore frequently consulted by colleagues on judicial law matters for advice or to assist them in proceedings.

He also benefits from a solid experience in the field of litigation concerning noise pollution related to air transport, both before the courts and tribunals of the judicial order and before the Council of State. He also has experience in litigation, both individual and class action, relating to passenger’s rights.

Through his more than ten years’ involvement in litigation related to Brussels National Airport, he has developed a knowledge of the aviation sector and its various players, in particular the relationship between the public authority and the air traffic controller and the management of traffic by the air traffic controller.

ACADEMIC ACTIVITIES

In addition to his work as an advocate, Marc has had an academic career for many years. He has been an assistant in Constitutional Law (UCL), Administrative Law (ULB) and Introduction to Law (ULB), and since 2010 he has been a member of the Judicial Law Unit of the Université Libre de Bruxelles as an assistant lecturer for the Civil Litigation Law course.

He regularly gives lectures and is the author of numerous articles and books on judicial law, public law and transport law. He is also co-author of books on civil litigation law.

He is also a member of the Judicial Law Commission of the Journal des Juges de paix (JJP).
